fda guidanceThe pharmaceutical and biologics industry recently received updated FDA guidance on the use of Generally Accepted Scientific Knowledge (GASK) in regulatory submissions.

 

The FDA guidance provides new examples of when it is applicable to leverage GASK data to meet safety requirements required in a new drug application. Clinical information in the drug discovery data that supports the nonclinical safety of a drug can contain GASK citations. Additionally, the citations would be based on existing clinical studies that have been validated by FDA in approved products on the market.

 

What is GASK?

 

Generally Accepted Scientific Knowledge refers to information and methods widely considered as accepted by life science industry experts. It can include established scientific principles, published papers, and best practices that have passed the regulatory scrutiny of drug development. GASK is most often utilized during the evaluation of safety and efficacy data of regulated products.

 

FDA Approval

 

The FDA guidance elaborates on the process of FDA regulators and how new drug applications are evaluated. Further, the FDA often requires life science companies to provide a significant amount of regulatory data to support safety and efficacy claims.

 

This regulatory clinical research often comes from clinical trials, preclinical studies, and other types of scientific data sources. However, in scenarios where there may be limited clinical trial data conducted, GASK can be used to provide supporting documentation for regulatory compliance. 

 

Drug Development

 

Life science companies are required to offer nonclinical information to support regulatory approval of a New Drug Application (NDA) or Biologics License Application (BLA). Additionally, the FDA guidance elaborates on how nonclinical information helps the Agency focus on important matters, such as:

 

  • Identifying pharmacological effects, including the mechanism of action of the drug in vitro and/or in vivo
  • Identifying absorption, distribution, metabolism, and excretion of the drug in vitro and/or in animals
  • Identifying possible consequences of exposure duration (e.g., chronic)
  • Identifying risks for special populations (e.g., pediatrics)

 

Regulation Examples

 

The FDA guidance goes on to describe unique conditions in which sponsors have successfully used GASK in their product development program. Each sponsor cited these GASK resources to meet FDA’s regulatory approval requirements instead of conducting certain nonclinical studies:

 

  • Products containing a substance that naturally occurs in the body. Sponsors submitted GASK regarding that substance and the known effects on biological processes.
  • Demonstrated drug impact on a particular biological pathway. Sponsors submitted GASK regarding the impact and FDA regulators concluded specific nonclinical studies were not necessary to support drug approval and drug labeling.

 

Active Ingredient

 

The FDA guidance continues by listing examples of substances that are typically present in a healthy human body. For example, endogenous substances where the drug replaces a substance that should naturally be present but, for pathological reasons, a patient may lack sufficient amounts. The FDA approved drug may enable and help accelerate the proper functioning of the human body.

 

Pharmacological

 

Additionally, a key driver of using GASK for FDA approval is the patient who has been prescribed a drug & the pharmacological impact experienced. Existing human pharmacokinetic studies and toxicology studies are recommended and may support the approval of the regulatory application. Specifically, regulators wil look to examine if the drug helps increase the level of the endogenous substance to the level of a healthy individual.  

 

Diet

 

Further, exogenous substances that are already present in a patient’s diet may help expedite U.S. Food and Drug Administration approval. This scenario includes a patient’s exposure to an unmodified food substance that doesn’t exceed typical levels of dietary exposure when the drug is taken orally. The FDA guidance also states that certain nonclinical studies may be unnecessary based on the relevance of the exogenous substance to the clinical research submitted. 

 

New Drug Application

 

If an FDA sponsor utilizes GASK information in their new product application, they must submit justification in the appropriate regulatory submission filing (e.g. BLA submission, 510(k) submission, etc.). The FDA guidance recommends as early as possible in product development to the assigned FDA regulator.

 

Finally, food and drug regulation feedback would be provided to the sponsor for the proposed regulatory strategy for approval. The FDA submission should incorporate evidence for the use of GASK, including textbook excerpts and/or non-product-specific published literature.

The FDA Center for Devices and Radiological Health (CDRH) recently published new guidance for medical device priorities in 2023. The FDA CDRH guidance looks to evolve away from the COVID-19 pandemic and transition toward digital health, medical device software and regulated software as a medical device (SaMD).

 

Cybersecurity for Medical Devices

 

Among topics the FDA guidance considers “A-List” priorities is cybersecurity for medical devices. Two initial priorities of the FDA guidance will include a deeper study of quality system (QMS) considerations and premarket submission (PMA) content.

 

Additional FDA software guidance was published earlier this year (September 2022) that described how software functions meet the definition of a medical device and risks to the public. The change industry should keep an eye on is FDA product specific guidance that applies to regulating software development that impacts risk to patient safety.

 

Quality Management System

 

Quality management system regulation currently falls under 21 CFR 820, so it will be interesting to see how new updates are developed based on discussion with industry. Every medical device manufacturer is required to have a compliant QMS system that includes the necessary QMS documentation for regulatory approval.

 

As digital healthcare integrates the physician-patient relationship, FDA continues to scrutinize device software functions and healthcare mobile apps. Lastly, these insights may provide additfeedback on software functions not subject to FDA regulatory requirements relevant to a QMS audit.

 

Remanufacturing Medical Devices

 

FDA is taking a deeper look at reusable medical devices and how preventive maintenance increases the life of a medical device. Currently, there are separate regulations for both industry manufacturers and 3rd party service companies. FDA will look to clarify the differences between “servicing” and “remanufacturing”, and the impact on medical device safety for either. This will likely impact the regulatory responsibilities of companies who perform these activities for health care providers.

 

Premarket Authorization (PMA)

 

Software as a medical device continues to grow across the health care industry. Updated premarket authorization guidance will focus on software devices with consideration to how the software is delivered to the end user. This can include factory-installed healthcare software or platforms installed by a third-party vendor.

 

Equally important, new information is anticipated for different types of firmware and software-based control of medical devices. Industry employees should also anticipate greater clarity for stand-alone software applications and general purpose computers. Leadership at FDA has included subtle hints that accessories to medical devices that include software may also be included in future FDA guidance for industry.

 

COVID-19 Emergency Use Authorization (EUA)

 

There has been discussion around the 180-day timeline proposed for notice of ending a medical device EUA due to COVID-19. Final guidance should be available in 2023 that provides more detail about on the appropriate transition period. FDA is considering industry recommendations that avoid disruptions to product shortage and supply chain.

 

Further, consideration is also being given to medical device manufacturer and healthcare providers to adjust from policies adopted during the public health emergency (PHE). For example, an EUA issued under section 564 of the FD&C Act will remain in effect. Primary changes will be based on if FDA chooses to revoke the EUA because the criteria for issuance is no longer met. 

 

Voluntary Improvement Program

 

FDA and the Medical Device Innovation Consortium (MDIC) continue to advance their pilot program launched in 2018. Select medical device manufacturing sites were chosen to review key business processes using a series of integrated best practices. The Capability Maturity Model Integration (CMMI) Institute certified select team to conduct and review quality system maturity of these sites.

 

Additionally, 2023 will likely bring even more data surrounding the MDIC program. This could include public info for industry about continuous improvement through quarterly check-in progress with participating medical device companies. The program is designed to report industry baseline metrics after the check-in and monitor operational excellence.

 

Breakthrough Devices Program

 

New information from FDA will arrive in 2023 for updates to the Breakthrough Devices Program. Early updates suggest the guidance will clarify how the program may be more applicable to certain devices than others. FDA breakthrough designation often benefits populations that are more likely to be impacted by health care disparities. New clarity may include breakthrough therapy designations and how medical device companies can educatee sponsors to submit for proposed indications of use. 

 

Finally, an important facet of the breakthrough devices program is the type of evidence needed for FDA approval. Clarity should help to determine whether a device is reasonably expected to increase the treatment or diagnosis efficacy. Moreover, early indications suggest that the intended use of the device, technology and features, and the available standard of care alternatives will all play a role.

A recent update for Health Canada and EMA’s data anonymization program included instructions for filling out the new clinical template and a more granular look inside the harmonized Anonymization Report (AnR). Further, the goal of this regulatory harmonization program is to make EU and Health Canada identification of specific patients from characteristics in the data set as highly unlikely as possible.

 

What is Data Anonymization?

 

Data anonymization is a method for presenting research data in a way that reduces our ability to identify the individuals who participated in the clinical study. Best practices for Clinical anonymization commonly target how to protect the trial participant’s data and clinical trial drivers, such as:

 

  • Device manufacturer
  • Drug manufacturer
  • Device trade name
  • Drug trade name

 

Patient data and re-identification can also be linked to outlier conditions to be considered:

 

  • Protocol design vs. advanced methods
  • Special populations
    • Rare disease state
    • Ultra rare disease state

 

Finally, consideration must be given to small trial populations that can limit the intended scope of patient disclosure. For example, since there are fewer patients in the trial, any form of incomplete anonymization often leads to an increased risk of re-identifying a trial participant.

Drug Sponsors

 

The regulatory process will now include drug sponsors submitting only one anonymization report for both Health Canada and EMA regulatory submissions. The updated report format for both Health Canada and EMA uses a mix of predefined, multi-choice questions and verbatim response questions. Additionally, the format is optimized for clinical data sharing between each regulatory body to improve transparency and product efficacy. 

 

A drug sponsor’s anonymization methodology would include a risk assessment that shows either a qualitative or quantitative calculation (or a combination based on clinical strategy). Redacted copy options include both Personal Information that satisfies Health Canada regulatory and Protected Personal Data for the EMA regulatory format. Finally, direct identifiers of both the clinical report signatory and principal investigator should be listed with the rationale for each clinical approach used.

 

Adverse Events (AEs)

 

Indirect identifiers are anonymization report categories often about clinical data specifically related to the trial (or product used in the clinical trial). This information is not enough to stand on its own in terms of independent study variables. Instead, the data analysis is dependent on the clinical trial to connect the differences between patient information and an actual participant.

 

All adverse events (and terms related to the adverse event) should be recorded in these formats:

 

  • Summary level
    • Tables and/or descriptive summaries
  • Participant level
    • Written patient narrative based on AEs

 

Special Populations

 

Select clinical trial participants may fall under the anonymization category of special populations. These participants often include a sub-set audience that is impacted by either the patient’s life events or stage of life while participating in the clinical trial. Special populations often warrant a different level of clinical segmentation that should be documented and analyzed in the final reporting submission.

 

Further, their current health condition may warrant creating a clinical subset of participants for regulatory approval, such as:

 

  • Trial specific examples:
    • Pediatric
    • Geriatric
  • Patient specific examples:
    • Pregnant women
    • Breastfeeding women.

 

In the context of anonymization, these special populations may need a unique reporting strategy since they often do not share all key characteristics of the trial population.
